Scope of Services

Team Bross handles legal representation and consultation in the following general areas of law: criminal defense, personal injury and wrongful death, injunctions (restraining orders), evictions, civil litigation and other related practices. Team Bross provides these services to individuals and entities all across Florida, with a concentration in Central Florida. All initial consultations are free of charge to review your case and discuss legal options. Legal service engagement is memorialized in writing between you and Team Bross, including scope of work, fees, and terms of representation.

Attorney-Client Relationship

Your use of the Team Bross website or communications with members of Team Bross’ attorneys do not create an attorney-client relationship with you and Team Bross unless and until an engagement letter or retainer agreement has been signed by both parties. Any information you receive via the website or via email before you have retained counsel is for general information purposes only, not legal advice. There is no client-attorney privilege until after you have retained Team Bross for legal services.

Responsibilities and Duties of the User

Fees and Payment

Team Bross believes in billing that is simple and fair. We offer easy payment plans on a fair payment schedule so it is affordable for all of our clients. All of our initial consultations are free of cost to all potential clients. Upon engagement, the retainer fee, appointment scheduling and other payment terms will be discussed in your engagement agreement. You are directly responsible for payment of all agreed upon fees. Privacy and Confidentiality

Team Bross cares about your privacy and safety. Any case facts and personal information you give to us as part of the attorney-client relationship are confidential, subject to the Florida Bar’s ethical rules and applicable laws. Communications with Clients

We have an open and transparent dialogue with our clients. Once you hire Team Bross we communicate with you about the status of the case, any next steps required, and all upcoming deadlines. Cessation of Services

With or without cause, either you or Team Bross may at any time seek to terminate the attorney-client relationship, in accordance with the terms of the engagement agreement and applicable law. In order to terminate our services, it is necessary that you make this termination in writing. Upon termination, you shall remain liable for all fees and expenses incurred through the date of termination. Team Bross further reserves the right to withdraw from representation in accordance with all applicable professional and ethical responsibilities, including on grounds of non-payment of fees, conflicts of interest or breakdown in communication.

The above is from a client agreement for a law firm. Most professional services contracts have some language like this somewhere in them. It’s meant to not only inform the client that he/she has the right to terminate the agreement (as most clients know), but also to provide some language with which a lawyer might address a complaint about the lawyer. If a lawyer provides notice to a client that he/she is disengaged, the lawyer can also use the email as evidence that they be sued – “Your Honor, I provided notice of disengagement pursuant to the engagement letter ‘and in compliance with all applicable professional and ethical responsibilities’, so I should be dismissed from this action.”

As the client agreement states: both sides may terminate the contract for any reason. Because the law leaves that decision entirely up to the discretion of both parties, ethical guidelines on attorney-client relationships generally absolve attorneys from responsibility for providing adequate services if it was compelled to withdraw because a client terminated the contract; as a result, contractually compelling lawyers to continue allowing them to earn fees undermines that contract. Also as a consequence, sometimes clients will refuse to allow attorneys who they feel are shoddily performing their work from withdrawing – although such behavior usually provides more proof of shoddy client services, leading to non-refundable contracts becoming flat-footed.

It’s important for lawyers writing an engagement letter or contract with a client to provide themselves with protection from further action by providing notice of disengagement (where appropriate) in compliance with their professional duties.

Applicable Law, Jurisdiction, and Venue

These Terms of Service and any disputes related to your use of the Team Bross website or legal services are subject to the laws of the State of Florida, without regard to their choice of law principles. You agree that any action or proceeding relating to these Terms or your engagement of Team Bross shall be brought exclusively in the state or federal courts located in Brevard County, Florida. You consent to the personal jurisdiction of such courts for such purposes.

Dispute Resolution

Per Team Bross Website: “If any controversy arises out of your use of the website, Team Bross encourages a good faith negotiation and resolution. In the event that a controversy cannot be informally resolved, the dispute may be mediated or arbitrated in Brevard County, Florida, as mutually agreed upon. Nothing in this section is intended to limit the right of either party to seek equitable or injunctive relief in a court of competent jurisdiction.”

They supersede all previous or contemporaneous agreements, understandings, representations and warranties, both written and oral.
